Terms of Service

These Terms govern your use of the FlowVia platform (the “Service”) provided by Kieran Cromie, trading as FlowVia (“we”, “us”). By using the Service you agree to these Terms.

The Service

FlowVia provides AI receptionist and chatbot software that answers enquiries, captures leads, and integrates with your tools. The AI is designed to triage and hand off to your team; it does not replace professional advice and may make mistakes.

Your responsibilities

  • Provide accurate configuration and ensure you have a lawful basis to process the enquirer data you collect through the Service.
  • Comply with applicable law, including UK GDPR, PECR (marketing), and estate-agency and AML regulations.
  • Obtain any consents required for call recording, messaging, and marketing follow-ups.
  • Keep your account credentials and API keys secure.

Acceptable use

You must not use the Service to send spam, harass, break the law, or attempt to disrupt or reverse-engineer the Service. We may rate-limit, suspend, or terminate accounts that abuse the Service.

Fees

Fees, billing interval, any setup fee, and trial terms are as agreed in your plan and shown at checkout. Charges are billed in advance via our payment processor and exclude VAT unless stated. Late or failed payments may result in suspension.

Intellectual property

We retain all rights in the Service. You retain rights in your own data and content. You grant us the limited rights needed to operate the Service for you.

Availability & liability

The Service is provided “as is”. We aim for high availability but do not guarantee uninterrupted service. To the extent permitted by law, our total liability is limited to the fees you paid in the 12 months before the claim, and we are not liable for indirect or consequential loss. Nothing limits liability that cannot be limited by law.

Termination

You may cancel at any time via the billing portal; access continues to the end of the paid period. We may suspend or terminate for material breach. On termination we will, on request, make your data available for export for a reasonable period before deletion.

Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
